LIA's Statement about April Visa Bulletin

On March 14th, 2008, The Department of State (DOS) published its April Visa Bulletin, which determines the visa number allocation across different Employment-Based (EB) categories and different countries. To our surprise, in the Bulletin, DOS granted a substantial amount of visa numbers to Indian EB2 applicants by moving their cutoff date from “unavailable” to December 1, 2003 while keeping the cutoff date for Chinese EB2 applicants unchanged. Since both Chinese and Indian EB immigrants are suffering from the visa number backlog and have to wait four to ten years for their green cards, this biased treatment in favor of one group over the other greatly worsens the agony of Chinese immigrants and would probably add years to their already distressing immigration journeys.

Dear LIA member, after an inactive holiday season, it is time for us to come back and give a final charge toward our agenda before the presidential election. This year, our targets remain the same: visa number recapture (up to 217,000) and advanced degree H1B waiver, or practically, OPT extension.
